End-User License Agreement (EULA) for Fit-rics

This End-User License Agreement ("Agreement") is a legal agreement between you ("User") and Fit-rics ("Company", "we", "us", or "our") regarding your use of the Fit-rics software application ("Application"). By accessing or using the Application, you agree to be bound by the terms of this Agreement.

1. Medical Disclaimer (READ CAREFULLY)

The Application does not provide medical advice. The metrics, projections, race strategies, and calculations provided by Fit-rics are for informational and educational purposes only.

• Consult a Physician: Always consult with a qualified healthcare professional before beginning any diet or exercise program.
• Risk of Injury: You understand that physical exercise involves strenuous physical movement and carries the risk of injury or death. You assume all risks associated with your use of the Application.

2. License Grant

Fit-rics grants you a revocable, non-exclusive, non-transferable, limited license to use the Application for your personal, non-commercial purposes.

3. Data Privacy and Security

• Data Storage: The Application uses Google Firebase. Your personal data is stored in a secure cloud environment.
• Access: We do not sell your personal data. Data is accessed only to provide functionality.
• Security: While we implement industry-standard security measures, no method of transmission over the internet is 100% secure.

4. User Accounts

To access certain features, you must sign in using a Google Account. You are responsible for maintaining the confidentiality of your login credentials.

5. Intellectual Property

The Application, including its code and "Aether Kinetics" design system, is the property of Fit-rics and is protected by copyright laws.

6. Limitation of Liability

To the maximum extent permitted by law, Fit-rics shall not be liable for any special, incidental, indirect, or consequential damages arising out of the use of the Application.

7. Termination

We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason whatsoever.

8. Governing Law

This Agreement shall be governed by the laws of the State of Minnesota, United States.
